Advice for people whose previous settled status has lapsed and who wish to return to live permanently in the UK.
We assess your earlier indefinite permission and absence history to establish whether your status has lapsed.
We review your continuing UK ties and plans to return for settlement before advising on the appropriate application.
The Returning Resident route is for eligible former settled residents whose indefinite permission has lapsed through absence. It is distinct from returning while settlement remains valid or resolving a problem with proof of status.
We assess the type of permission previously held, relevant exceptions and your present circumstances before recommending the next step.
We prepare your case around the previous settlement, time overseas and intended permanent return.
Review your previous status, departure and subsequent travel history.
Advise on supporting information and prepare representations addressing UK ties and individual circumstances.
Assist with the overseas application, submission and relevant identity or biometric process.
Review the decision, explain the permission granted and advise on the next steps for returning to the UK.
Where a Returning Resident application is required, it is made from outside the UK and entry clearance must be obtained before arrival. We assess the relevant process and timing.
The period after which indefinite permission lapses differs between ordinary settlement and settled status under the EU Settlement Scheme. Specific exceptions may also apply.
We assess the relevant rules against the actual travel and permission history rather than assuming that every absence has the same effect.
We review your ties to the UK, reasons for living abroad, current circumstances and intention to return permanently. The assessment is individual; having held settlement before does not guarantee a successful application.
Where relevant, we can assess whether provisions connected with the Windrush Scheme or another appropriate process should be considered.
There is no dependant provision on this route. Each partner or child must qualify as a Returning Resident in their own right.
Where a relative does not qualify independently, we assess whether a separate family or other immigration route is appropriate.
We review each person’s previous permission, absences and present status, including any separate requirements affecting children.
One successful Returning Resident application does not automatically restore status to the whole family.
An expired document does not necessarily mean that indefinite permission has lapsed. We review the underlying grant and whether the issue concerns digital status, identity details or evidence of permission.
Where settlement remains valid, different arrangements may apply from those for a Returning Resident application. We assess the appropriate step before travel.
If an application has been refused, we can review the decision and advise on any available administrative review or other appropriate response.
A successful Returning Resident application grants entry clearance for settlement. We explain the decision and matters relevant to maintaining status after returning.
Future prolonged absences may affect indefinite permission, so we can review travel plans and the applicable exceptions.
Restoring settlement does not automatically confer citizenship or establish eligibility for naturalisation. We assess nationality options separately, including the effect of earlier absences and the relevant residence conditions.
