Further Submissions & Fresh Claims

Advice on new representations after an earlier protection or human rights claim, with a careful review of your case and its next steps.

At a Glance

Review an earlier case

We assess the previous protection or human rights claim, the outcome and the issues requiring further advice.

Consider new material

We review new information or changed circumstances alongside the material already considered.

Advice after a previous claim

Further submissions may be relevant after an earlier protection or human rights claim has ended. We assess the procedural position before recommending the appropriate next step.

If your original claim or an appeal is still pending, new information may need to be raised within that existing case instead.

Process and Procedure

Our service starts with a review of the earlier case and the purpose of the proposed submissions.

  1. Review the case history

Examine previous decisions, appeal findings and your current circumstances.

  2. Assess new material

Consider the relevance of new evidence and any changes since the earlier decision.

  3. Prepare representations

Present the case and advise on the appropriate submission and appointment arrangements.

  4. Decision and follow-up

Explain the outcome and assess any further action available in your case.

The procedure depends on the grounds raised and your circumstances. We advise on the applicable arrangements rather than treating every case as the same application.

New Evidence and Changed Circumstances

Build on the full history

We assess new material in context, including earlier explanations, findings and any issues that affected the previous outcome.

Present the individual circumstances

Our review can include changes in personal circumstances, relevant country developments and information that was not previously assessed. We help explain why the material matters to the case.

Prepare a clear account

We advise on how the evidence and representations fit together, identify gaps and discuss any difficulties that need to be addressed before submission.

Family and Human Rights

Family circumstances

We review the position of partners and children, including relevant changes since the earlier case.

Protection concerns

We assess each person’s circumstances and whether separate protection issues need to be raised.

Choose the appropriate application

Human rights representations and protection submissions can require different procedures. We review whether further submissions or another application is appropriate.

Related advice may include private life and family life applications and asylum and humanitarian protection.

Decisions and Challenges

Further submissions and a fresh claim

Making further submissions does not automatically mean the Home Office accepts a fresh claim. We assess the legal test against the earlier material and explain how it applies to your circumstances.

Understand the outcome

We review whether the decision grants permission, refuses a fresh claim or rejects the submissions without accepting a fresh claim.

An appeal is not available against every rejection. We assess the decision, any appeal entitlement and the relevant deadline before advising on a challenge.

Status and Next Steps

Your position while submissions are considered

We advise on your current immigration position, Home Office correspondence and any individual conditions or reporting obligations. Further submissions should not be treated as a visa extension or automatic permission to work.

Following the decision

If permission is granted, we explain its basis and conditions and any future application that may be appropriate. Renewal, settlement and nationality advice depend on the status granted.

If removal action or an urgent deadline is involved, let us know when you contact us so that the immediate position can be assessed.
