Windrush Scheme

Advice for eligible people seeking to establish their immigration status or nationality through the Windrush Scheme.

At a Glance

Your residence and nationality

We assess your arrival, residence and nationality history against the relevant scheme provisions.

The appropriate outcome

We review whether the case concerns confirmation of existing rights, settlement or an eligible citizenship application.

Assess the individual history

The scheme supports eligible long-standing residents who need to establish their rights. It is not limited to people of Caribbean origin, but its specific eligibility groups must be assessed.

We review the complete history before recommending the appropriate application or another immigration or nationality option.

Process and Procedure

We assist with the relevant Windrush Scheme application and help explain the individual circumstances to the Home Office.

  1. Initial assessment

Review arrival, residence, nationality and any earlier immigration decisions.

  2. Prepare the case

Advise on the available information and address gaps or difficulties in the historical record.

  3. Application and identity checks

Prepare the appropriate UK or overseas application and assist with the relevant identity process.

  4. Decision and next steps

Review the outcome, explain the status confirmed or granted and advise on further action where appropriate.

Application arrangements

Windrush Scheme applications do not carry a Home Office application fee. We explain the relevant application process and distinguish government charges from any separately agreed professional services.

Residence and History

Build the individual picture

We assess the relevant nationality, dates of arrival, residence and earlier status alongside the circumstances of any time spent overseas.

Older records may be incomplete or inconsistent. We review what information is available and how the history can be presented clearly for consideration.

Review previous difficulties

We consider earlier correspondence, decisions and problems proving rights when advising on the appropriate next step. We can assist with explanations of discrepancies and individual circumstances.

Family and Overseas Cases

Family history

Some children of eligible Commonwealth citizens fall within the scheme. We assess the relevant parent’s history and the applicant’s own circumstances.

Applicants outside the UK

Certain former residents overseas may qualify. We review earlier status, absences and the intended return before advising on an application.

Assess each family member

Eligibility does not automatically extend to every relative. We assess each person’s position and whether another immigration or nationality application is needed.

For a proposed permanent return, we also consider the relevant Returning Resident provisions where appropriate.

Status and Next Steps

Understand the appropriate outcome

The outcome depends on the individual eligibility group and existing rights. We explain whether the case involves confirmation of British citizenship, right of abode, evidence of settlement or another available grant.

Proof of status

We review the decision and any follow-up needed to demonstrate status, including digital-status questions where relevant. Establishing existing rights and applying for a new status are different assessments.

If the circumstances fall outside the scheme, we can review the appropriate alternative immigration or nationality route.

Citizenship and Other Matters

Citizenship under the scheme

Certain eligible applicants may be considered for citizenship, while others may already be British. We assess the relevant provisions and explain any further application or confirmation needed.

British passport applications are separate and are not covered by the Windrush Scheme.

The separate Compensation Scheme

The Windrush Compensation Scheme concerns eligible losses linked to difficulty proving the right to live in the UK. It has its own eligibility and claim process; a status application does not itself make a compensation claim.

We can discuss your circumstances and identify the separate issues requiring assessment.
